With this privacy policy, we would like to inform you about the collection, processing and use (hereinafter referred to as “use”) of personal data. You can find out how you can object to the use of your personal data in accordance with the relevant data protection regulations here.
Collection, processing and use of personal data
Personal data is information about your personal or factual circumstances, in particular your name, date of birth, e-mail address, telephone number or postal address. Agrobrain GmbH uses the personal data provided by you insofar as it is necessary for the establishment, execution or termination of a legal or similar obligation with you or for the use of a service provided by us. This is the case, for example, when registering for the newsletter or when responding to any contact inquiries. In these cases, we use your personal data exclusively in order to be able to process your respective request. You are free to decide whether you provide us with your data for these purposes.
Newsletter
You have the option of subscribing to our newsletter via our website. To do this, we need your e-mail address and your declaration that you agree to receive the newsletter. In order to provide you with targeted information, we also collect and process voluntary information on areas of interest, company headquarters, etc. As soon as you have registered for the newsletter, we will send you a confirmation e-mail with a link to confirm your registration.
You can cancel your subscription to the newsletter at any time. Either via the “Unsubscribe” link in the newsletter or please send your cancellation to the following e-mail address: office@agrobrain.ch. We will then immediately delete your data in connection with the newsletter mailing.
If you subscribe to our newsletter, the information you provide will be encrypted on the basis of our legitimate interest pursuant to Art. 6 para. 1 lit. f. GDPR. GDPR to our web-based CRM system of weclapp GmbH (Frauenbergstraße 31 – 33 in 35039 Marburg). Weclapp stores and processes this data on our behalf exclusively on servers in Germany. Double opt-in and logging
The registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registering, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary to ensure that no one can register using other people’s email addresses. Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address. Changes to your data stored by CleverReach are also logged.
Use of the mailing service provider “CleverReach“
The newsletter is sent using “CleverReach”, a newsletter mailing platform from CleverReach GmbH & Co. KG, Mühlenstrasse 43, 26180 Rastede, Germany.
The email addresses of our newsletter recipients, as well as their other data described in this notice, are stored on CleverReach’s servers in Germany. CleverReach uses this information to send and analyze the newsletter on our behalf. Furthermore, CleverReach may, according to its own information, use this data to optimize or improve its own services, e.g. for the technical optimization of the dispatch and presentation of the newsletter or for economic purposes in order to determine from which countries the recipients come. However, CleverReach does not use the data of our newsletter recipients to write to them itself or pass it on to third parties.
We trust in the reliability and IT and data security of CleverReach. CleverReach undertakes to comply with EU data protection regulations. Furthermore, we have concluded a “contract for the commissioned processing of personal data (in accordance with GDPR9) with CleverReach. This is a contract in which CleverReach undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties.
Statistical survey and analyses
The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file that is retrieved from the CleverReach server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval, is initially collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.
The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of CleverReach to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
Online access and data management
There are cases in which we direct newsletter recipients to the CleverReach website. For example, our newsletters contain a link that newsletter recipients can use to access the newsletter online (e.g. in the event of display problems in the email program). In this context, we would like to point out that cookies are used on CleverReach websites and that personal data is therefore processed by CleverReach, its partners and the service providers used (e.g. Google Analytics). Legal basis for the General Data Protection Regulation
In accordance with the provisions of the General Data Protection Regulation (GDPR) applicable from May 25, 2018, we inform you that the consent to the sending of e-mail addresses is based on Art. 6 para. 1 lit. a, 7 GDPR and § 7 para. 2 no. 3 and para. 3 UWG. The use of the mailing service provider MailChimp, the implementation of statistical surveys and analyses as well as the logging of the registration process are based on our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. We are interested in using a user-friendly and secure newsletter system that serves both our business interests and the expectations of users. We would also like to point out that you can object to the future processing of your personal data at any time in accordance with the legal requirements pursuant to Art. 21 GDPR. In particular, you may object to processing for direct marketing purposes.
Duration of storage of your data
The data you provide us with will only be stored by us for as long as is necessary to fulfill the purpose for which you have provided us with your data or to comply with legal requirements. If you have given us your express consent to use your personal data for advertising purposes (registration for the newsletter), we will use your data for these purposes as long as you do not revoke your consent. You can revoke your consent at any time with effect for the future.
Limited disclosure
When processing your request, it may be necessary for Zolti Luky to disclose your personal data to other affiliated companies or external service providers who act exclusively on our behalf. Such service providers may, for example, be commissioned with the dispatch of products or the distribution of advertising materials. Agrobrain GmbH requires all affiliated companies and its external service providers to use your personal data exclusively in accordance with our instructions and in compliance with this privacy policy and the legal requirements for commissioned data processing. Otherwise, we do not pass on personal data to third parties or sell or rent data without your consent.

So-called “cookies” are used on our website. You can adjust your cookie settings at any time. We also use the Google Analytics web analysis tool. This tool uses cookies. It is not necessary to comply with a special form, for example, write to us by e-mail at office@agrobrain.ch.
Data security
We have taken technical and organizational measures to protect your data from loss, alteration or unauthorized access. We are constantly improving these security measures in line with technological developments.
Updating and amending
Parts of the privacy policy may be amended or updated by us without prior notification to you. Please check the privacy policy before you use our website to ensure that you are up to date with any changes or updates.
